These Website Terms of Use (Terms) govern your access to and use of www.hubse.com.au and its content, forms and online features (Website). The Website is operated by Hub electrical Solutions (ABN 61 001 423 981 trading as Hub Solar and Electrical, NSW contractor licence 316586C) (Hub, we, us or our).
By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website. If you use the Website for a business or another person, you represent that you have authority to do so.
These Terms govern the Website only. They are not a quote, building contract, electrical services contract, solar installation agreement, warranty, finance agreement or agreement to perform work.
Any goods or services we agree to supply will be governed by a separate written quotation, scope, customer contract or other terms accepted by the parties (Service Contract). If these Terms conflict with a Service Contract in relation to goods or services, the Service Contract prevails to the extent of the conflict. Nothing on the Website means that we have accepted an enquiry or agreed to attend, perform work or supply equipment.
Website content is general information only. It is not electrical, engineering, structural, building, safety, financial or legal advice and must not be used as instructions to install, alter, test, energise, isolate, repair or remove electrical equipment.
Electrical wiring work in NSW must be carried out by, or under the supervision of, appropriately licensed persons. Do not open switchboards, remove covers, work on or near live electrical parts, access a roof, disconnect safety devices or attempt electrical work based on Website content. Arrange an appropriate site assessment and follow the directions of qualified personnel and emergency authorities.
An online form, email or voicemail may not be monitored continuously. Do not rely on it for an urgent electrical fault, fire, electric shock, sparking, smoke, burning smell, fallen powerline or other immediate hazard.
A Website form, call-to-action, calculator result, appointment request or other enquiry is an invitation to contact us. It does not create a booking or contract. A booking is confirmed only when we expressly confirm it, and an agreement for work arises only in accordance with the applicable Service Contract.
You must provide accurate, current and complete information and tell us about circumstances relevant to access, design or safety, including known asbestos, fragile roofing, concealed services, hazardous materials, structural concerns, restricted access, animals, tenants, strata requirements and other work occurring at the site. Providing information does not transfer responsibility for matters that require our own assessment under law or the Service Contract.
Website descriptions, calculators, examples, package sizes, timeframes and indicative prices are general only unless expressly stated otherwise in a Service Contract. A final scope, design, price and timeframe may depend on a site inspection and matters such as:
Any variation, exclusion or additional work is dealt with under the applicable Service Contract and consumer law. Website qualifications do not authorise us to impose a charge or vary an agreed contract without a lawful basis.
Any estimate of solar generation, battery performance, self-consumption, grid export, electricity-bill savings, payback period or environmental benefit is based on assumptions and information available at the time. Actual results can vary materially because of weather and solar irradiation, shading and soiling, orientation and tilt, equipment degradation or failure, household or business consumption, tariff and retailer changes, export limits or curtailment, outages, maintenance, future building changes and other factors outside our control.
Unless an outcome is expressly guaranteed in a Service Contract, Website estimates and case studies are not guarantees of output, savings, income, payback, energy independence or future electricity prices. A result achieved at one property may not be achieved at another. You should review the stated assumptions and obtain advice appropriate to your property and circumstances.
Network connection, export permission, meter changes, retailer processing, Small-scale Technology Certificate eligibility, rebates, incentives, finance and other third-party programs are subject to legislation, program rules, administrator decisions, technical requirements, documentation, timing and availability. They may change or end.
A Website reference to an STC discount, rebate, incentive or approval does not guarantee eligibility or value. The applicable Service Contract will state any included assumptions, assignments, customer declarations and responsibilities. We are not responsible for a third party’s decision or delay, except to the extent responsibility cannot lawfully be excluded or we have expressly accepted it in a Service Contract.
Product images, colours, diagrams and installations shown on the Website are illustrative and may not exactly match the equipment, layout or finish suitable or available for your site. Product specifications, models, manufacturers, warranties, prices, promotions and availability may change. The goods and price that apply to an accepted job will be identified in the Service Contract, including any lawful agreed substitution or variation.
Unless clearly stated otherwise, prices shown to consumers are in Australian dollars and include GST where required. A partial or component price is not the total price unless clearly identified and accompanied by the total price where the law requires it. Errors may be corrected before a Service Contract is formed, subject to applicable law.
Goods and services supplied to consumers may come with guarantees and other rights under the Australian Consumer Law and other laws. Those rights cannot be excluded, restricted or modified where the law does not allow it. Manufacturer warranties and any express warranties from us operate in addition to, and do not replace, non-excludable consumer rights.
Nothing in these Terms excludes, restricts or modifies a consumer guarantee, statutory warranty or other right or remedy that cannot lawfully be excluded, restricted or modified. If a provision would otherwise do so, it is to be read down to the minimum extent necessary to be lawful.
You must not use the Website to:
Unless otherwise stated, the Website and its text, graphics, photographs, videos, layouts, logos, trade marks and other content are owned by or licensed to us and are protected by intellectual-property laws.
We grant you a limited, revocable, non-exclusive and non-transferable licence to access and use the Website for your personal or internal business evaluation of our services. You may print or save reasonable extracts for that purpose. You must retain notices and must not reproduce, adapt, distribute, frame, publish, sell or commercially exploit Website content without our prior written permission, except as permitted by law.
You retain ownership of material you submit, such as text, plans, photographs, reviews or testimonials. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and adapt submitted material to respond to your enquiry, assess or perform an agreed service, keep business records and exercise legal rights.
We will not publish identifiable photographs of your property or a testimonial for general marketing without permission. If you separately agree to publication, the permission and any agreed restrictions will apply. You represent that you have authority to provide submitted material and that our permitted use will not infringe another person’s rights.
The Website may link to or integrate with third-party websites, maps, reviews, calculators, finance providers, payment services, retailers, network businesses, manufacturers, social media or other services. A link or integration does not mean we control or endorse every aspect of that service. Third-party terms and privacy policies apply, and you should assess them independently.
We may change, suspend or withdraw all or part of the Website without notice. We do not guarantee that it will always be available, uninterrupted, secure or free from errors or harmful code. You are responsible for using suitable devices, software, backups and security precautions.
To the maximum extent permitted by law, Website content is provided on an ‘as available’ basis for general information. We do not make warranties about the Website’s completeness, currency, accuracy, availability or suitability for a particular property or purpose, except for an express warranty in a Service Contract or a guarantee or right that cannot lawfully be excluded.
To the maximum extent permitted by law, we are not liable for loss arising solely from reliance on general Website content instead of obtaining an appropriate site assessment or professional advice, or from Website unavailability, third-party services or unauthorised interference. This does not exclude liability caused by our negligence, breach of contract or other conduct where liability cannot lawfully be excluded or limited.
Where the law permits liability to be limited for a failure to comply with a non-excludable guarantee, our liability is limited, at our option, to the remedies permitted by the Australian Consumer Law. This clause does not apply where such a limitation would be unfair, unreasonable or unlawful.
To the extent permitted by law, you are responsible for reasonably foreseeable loss we suffer because of your unlawful use of the Website, deliberate security interference, infringement of third-party rights, or material breach of these Terms. You are not responsible to the extent the loss was caused or contributed to by us, and nothing in this clause limits rights that cannot lawfully be limited.
Our Privacy Policy explains how we handle personal information collected through the Website and our business. By providing personal information, you acknowledge that it will be handled as described in that Policy and any collection notice shown when information is collected.
We may update these Terms by publishing a revised version on the Website. The updated Terms apply to Website use after publication. Changes do not retrospectively alter an existing Service Contract unless that contract and the law allow it.
If part of these Terms is invalid or unenforceable, it is severed or read down to the minimum extent necessary and the remaining provisions continue. A delay in exercising a right is not a waiver. These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.
